I am a little concerned that a friend of mine got played. He married an english lady and I fear she used him to get australian citizenship, now they have only been married 6 months and she has left him.How long do people have to stay married for australian citizenship via marriage to be valid?
She didn't stay with him for nearly long enough. An Australian spouse visa is temporary for the first 2 years and only becomes permanent if the marriage is still intact after that time (and that's only for Permanent Residence - not citizenship). She could have left him after she gained her PR, but not before if she wants to stay here.
For citizenship, a person must live in Australia legally for at least 4 years including at least 1 year as a Permanent Resident. He should notify DIAC that she has left him and they will probably require her to leave the country even before her 2 years temporary visa expires.
Her next move will probably be to claim that she left because of domestic violence as in those cases, PR can still be granted, but those claims are investigated VERY carefully and a large number are rejected. How long do people have to stay married for australian citizenship via marriage to be valid?
If she married the guy for citizenship, and has left him before the two year probationary period, she just shot herself in the foot. Her visa will be revoked as soon as he reports her to the Immigration bureau.
They both may be investigated for visa fraud, especially if she tells immigration that he married her for the sole purpose of gaining citizenship.
He should act quickly because on top of what Ozmaniac said, if she claims domestic violence and he is found guilty, he may end up paying alimony and life support.
Not time for play, ignorance is not a bliss.
I dk exactly but I heard it takes up to 6-8 months just to get the fiance visa andthen another 3-6 months to be consider married.. Why would she want an australian citizenship does she go there frquently?
usually they must be together for 2 years before she gets a permanent visa
